There is no purchase necessary to enter or to receive a prize in the Black Enterprise Issue Survey Sweepstakes (the
"Sweepstakes"). One Sweepstakes winner (“Winner”) will be selected for each entry period (as described below) from
individuals who fully complete the applicable Black Enterprise Issue Survey, including, without limitation, the
inclusion of contact information. Submission of a fully completed survey will automatically enter the survey
respondent into the Sweepstakes. Limited to one entry per person. If an individual responds more than once to a
particular survey, only the first response received will be considered and subsequent responses disqualified. Responses
must be submitted via http://www.blackenterprise.com. All responses become the exclusive property of Sponsor.
Data collected from individuals responding to a survey will be kept confidential and aggregated with other data into a
composite report.
Eligibility
Entry
is open to any individual, who, at the time of entry, is 18 years or
older, and a
permanently
residing in the
spouse) and members of their same households (whether related or not), of Earl G. Graves Limited, Earl G. Graves
Publishing, Black Enterprise Magazine, or any of their respective affiliates, subsidiaries, suppliers, or advertising,
promotion or fulfillment agencies are not eligible to participate. The Sweepstakes is subject to all applicable federal,
state and local laws and regulations.

Sweepstakes is sponsored by Earl G. Graves Ltd. d/b/a BLACK ENTERPRISE,
NY 10011.
Prize
A
prize will be awarded to one (1) entrant per entry period. Prize
consists of one (1) gift cheque valued at $100.00 (
dollars). No substitution or transfer of prizes is permitted.
Selection
of Winner
Each entry period shall begin on the first day of each month and shall end on the last day of the immediately following
month. The Winner for a particular entry period will be randomly selected from all eligible entries received for such
period in a drawing conducted by Sponsor on the 15th day of the month immediately following the close of such entry
period. Non-winning entries will not be carried over into subsequent entry periods and will not be eligible for prize
drawings in entry periods other than the one during which they are submitted.
Winner will be notified by e-mail of his/her selection within 30 (thirty) days of the end of the applicable entry period.
Winner will be required to complete and return by mail within 10 business days of the receipt of such e-mail
notification an affidavit of eligibility and liability and, where legal, a publicity release, properly completed and
notarized, or the prize will be forfeited and awarded to an alternate winner. Return of any prize/prize notification as
undeliverable may result in disqualification and selection of an alternate winner. Sponsor reserves the right to verify
eligibility qualifications of any Winner and all decisions of Sponsor in connection with the Sweepstakes will be final
and non-appealable. The odds of winning a particular drawing will depend on the number of eligible entries received
during the applicable entry period. The name of the Winner will be posted at www.blackenterprise.com, or you may
write
to Sponsor at
of the applicable drawing for the name of the Winner of such drawing.
Restrictions/Limitation
on
Liability/General Information
Sponsor
reserves the right at its sole discretion to disqualify from entering
the Sweepstakes any person found: (i) to be
tampering
with the entry process or the operation of www.blackenterprise.com; or
(ii) to be violating the Official Rules
or
otherwise acting in violation of applicable law. ANY ATTEMPT BY A
SURVEY RESPONDENT OR ANY
OTHER
PERSON OR ENTITY TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE
LEGITIMATE
OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS,
FOR
WHICH SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT
PERMITTED BY LAW.
By
submitting a survey and participating in the Sweepstakes, the
respondent: (i) warrants and represents that he/she has
read
these Official Rules and based thereon, is eligible to participate in
this Sweepstakes; (ii) agrees to be bound by
these
Official Rules; (iii) consents to the use of his/her name and/or
likeness by Sponsor and/or its affiliates or
subsidiaries
for promotional purposes (whether online or through any other media now
known or hereafter developed),
without
additional compensation and unless prohibited by law; (iv) agrees, if
selected as a Winner, to be solely
responsible
for any and all taxes resulting from acceptance and receipt of a prize;
(v) agrees to release and hold
harmless
Sponsor and its directors, officers, employees, subsidiaries,
affiliates, agents, licensees, successors and assigns
from
any and all causes of action, liabilities, suits, cross-claims or
counterclaims, or any other claims arising out of or
relating
to his/her participation in the Sweepstakes, WHETHER OR NOT ARISING
FROM THE NEGLIGENCE OF
A
RELEASED PARTY, including, but not limited to, third party claims that
may be made against respondent, and
claims
arising out of or relating to acceptance, receipt, possession or
use/misuse of a prize, or any publicity or public
exposure
of respondent, including, without limitation, claims concerning
infringement or invasion of respondent's
privacy
or publicity rights, or defamation, or acts undertaken in preparation
for, or participation in, the Sweepstakes;
(vi) agrees
to assume all risks, express or implied, associated with all claims
released under subparagraph (v),
including,
without limitation, all risks concerning participation in the
Sweepstakes; and (vii) acknowledges that
Sponsor
has neither made nor is responsible or liable for any warranty, express
or implied, relative to the Sweepstakes
or any prize.
Without
limiting anything set out above, Sponsor assumes no responsibility, and
shall not be liable for: (i) any
damages,
taxes or expenses which any individual might incur as a result of
participating in the Sweepstakes or winning
a
Sweepstakes prize; (ii) any incorrect or inaccurate information,
whether caused by site users or by any of the
equipment
or programming associated with or utilized in the Sweepstakes; (iii)
any technical or human error which
may
occur in processing surveys submitted in connection with the
Sweepstakes; (iv) any theft or destruction of, or
unauthorized
access to, or use or alteration of, any Sweepstakes survey; and/or (v)
any malfunction, failure, or delay in
operation
or transmission caused by communications lines, computer equipment or
software, or technical problems or
traffic
congestion on any Internet access provider and/or at any online site,
including without limitation, injury or
damage
to any participant's person or property. Sponsor reserves the right, in
its sole discretion and without any
resulting
responsibility or liability, to cancel, modify or suspend the
Sweepstakes, including, without limitation, in the
event
of circumstances beyond its control (including without limitation,
infection by computer virus, unauthorized
tampering
or intervention, fraud, or technical failures) which prevent the
Sweepstakes from proceeding as planned or
which
adversely affect the administration, security, fairness, or integrity
of the Sweepstakes. Without limiting the
foregoing,
if, for any reason, the Sweepstakes cannot be run as originally
planned, for any reason, Sponsor, in its sole
discretion,
reserves the right to conduct the Sweepstakes from among all eligible
entries received, if any.
The
Sweepstakes is governed by the laws of the State of New York.
